The products purchased on the Hamradioshop website are sold directly by Hamradioshop (hereinafter referred to as Hamradioshop).

Remember that you have the right to request and receive support from Hamradioshop for online orders, returns, information on the delivery of ordered goods, or how to purchase online within 72 working hours from the request (excluding exceptional cases).

1. Our business policy

The Hamradioshop products in our Hamradioshop online catalog and the commercial services provided are available to end-users, defined by law as "Consumers" and "non-Consumers".
Product offers and their prices are valid as long as they are still visible and purchasable on Hamradioshop and in any case while stocks last.

"Consumer" means, pursuant to Article 18 of the Consumer Code, a natural person acting for purposes unrelated to his or her commercial, industrial, artisanal, or professional activity. We kindly ask you to include your "VAT number" in your personal data if you do not fall into the category of Consumers.

Offerprice reserves the right not to process orders received from users who do not adhere to the Hamradioshop commercial policy.

These general terms and conditions of sale exclusively regulate the offer, transmission, and acceptance of purchase orders regarding products on the Hamradioshop website between users of the Hamradioshop portal and the company Hamradioshop of Tersigni V. Dino itself, aimed at persons who have reached the age of majority (18 years).

The general terms and conditions of sale do not regulate the provision of services or the sale of products by third parties that use direct links to the Hamradioshop website through banners or other hypertext links. Before sending orders and purchasing products and services from these third parties, we suggest you check the general terms and conditions of sale and use of these third parties, as Hamradioshop can in no case be held responsible for the provision of services promised by third parties or for the execution of e-commerce transactions between Hamradioshop users and third parties.

 

2. How to conclude a contract with Hamradioshop

2.1
To place an order to purchase one or more products on the Hamradioshop website, you must complete all the pages in the cart and electronically transmit the page with all personal and purchase data to Hamradioshop, following the instructions you will find after adding a product to the cart and registering for the purchase.

2.2
The order page contains a link to these general terms and conditions of sale and also contains information on the main characteristics of each ordered product and its relative price (all applicable taxes included), the type of payment you used to purchase, the conditions for product delivery, the contributions required for delivery and transport, as well as references to the general terms and conditions for returning products purchased online.

2.3
An order will be considered submitted when Hamradioshop receives your order proposal electronically and the order information has been preliminarily verified as correct.

2.4
Before submitting your order proposal to Hamradioshop for the purchase of selected products online, you will be asked to carefully read the general terms and conditions governing the sale and purchase, to print a copy thereof using the print option, and to save or request a copy for personal use.

The order proposal will be archived in our databases for the time required to process your order, in accordance with current legislation. You can access the order by clicking on the section called
“MY PROFILE” or by contacting Customer Service. Furthermore, a copy of the electronic evidence related to the conclusion of the contract will be kept for the time provided by applicable civil and tax regulations.

Before proceeding with the submission of the order, you will be asked to identify and correct any possible errors that occurred during the compilation of the fields.

Orders to Hamradioshop must be in Italian.

After your order has been registered by Hamradioshop, it will be processed as soon as possible.

2.9
Hamradioshop may not accept and process your order if there are insufficient guarantees of payment solvency, if the orders are incomplete or incorrect, or if the products are no longer available. In the aforementioned cases, we will inform you via email that the contract has not been executed and that Hamradioshop has not confirmed your purchase order, specifying the reasons. In addition to the information provided, Hamradioshop is unable to provide more precise indications regarding product availability; therefore, once your order has been examined, we will inform you via email if some of the products you ordered are not available.

Notwithstanding the provisions of the General Conditions, it is understood that this order concerns divisible, distinct, and multi-economic unit sales services, corresponding to the number of products ordered, as expressly agreed between the Customer and Hamradioshop with the submission of the order itself and its acceptance; therefore, in the event that Offerprice's execution of the order is limited to some of the ordered products due to the unavailability of some or for another justified reason independent of Hamradioshop's will, by submitting this order, the Buyer declares their interest and gives their consent to the partial execution of the order regarding the other products, which therefore cannot be rejected by the Buyer, nor can it give the Buyer the right to revoke the order itself.
In the event that Hamradioshop is unable to fully accept the order received from the Customer, proceeding with partial acceptance of the order with regard to the available products, any exercise of the right of withdrawal provided for in Article 8 of these General Conditions will take place without any charge for transport costs to the Customer.

2.10
You are aware that by submitting the order to Hamradioshop, you unreservedly accept all the provisions contained in the general terms and conditions of sale of this contract with Hamradioshop and that you undertake to observe them. If you do not agree with any provisions contained in these general terms and conditions of sale, we kindly ask you not to send the order for the purchase of products on Hamradioshop.

2.11
By sending the order to Hamradioshop, you consent to and accept these general terms and conditions of sale as well as further conditions contained on Hamradioshop, including through links, including the general terms and conditions of use, the Privacy Policy, and the terms of withdrawal.

When an online order is confirmed, Hamradioshop will send you, at your choice, in writing or by email, the content of which must be stored on a durable medium, a copy of the purchase order receipt, containing a summary with information relating to the order (general terms and conditions of sale, the main characteristics of the purchased products, detailed information on the price, payment terms, existence of the right of withdrawal, times and methods for returning products, contribution for transport requested from the customer, geographical address to which any complaints can be submitted, and information on existing commercial guarantees and assistance services).

2.13
By sending the order to Hamradioshop, you agree to receive the invoice/tax receipt/sales receipt issued for tax purposes in electronic format. You can receive the paper invoice by expressly requesting it from our Customer Service.

3. Guarantees and product price indications

3.1
On Hamradioshop, we offer for sale products purchased by Hamradioshop directly from manufacturers, suppliers, and merchants carefully selected for their rigorous and stringent quality controls.

3.2
The products sold by Hamradioshop are of a quality never lower than the standard of the reference market.

3.3
The main characteristics of the products are indicated on Hamradioshop on the product's web page. Products offered for sale on Hamradioshop may not exactly match the actual product in terms of image and colors due to the browser or monitor type used. Images are for illustrative purposes only.
The technical specifications of a product, the approvals and safety declarations of an HRS branded product and any other product sold through the Site are indicated on the packaging or in the instructions for use of the product itself and may be reported in full or in extract on the Site itself as part of the Product's illustration.
All HRS branded products comply with standards and are approved according to European Community regulations. We are not responsible for any non-compliance with the standards of non-EU countries and/or lack of product approval in those countries.

3.4
The price of the products is expressed in euros and includes VAT, as well as all applicable taxes and duties, and shipping costs. Prices are subject to change. Check the final selling price before submitting the order proposal.

3.5
Orders placed from a website in a different country than the delivery country, or to addresses where Hamradioshop cannot deliver (e.g., P.O. BOX or territories/areas/zones not reached by our couriers), will be automatically canceled.

3.6
All products are delivered with an attached identification tag/label or sealed. Do not remove the seals from purchased products or the tag/label if you wish to return the purchased product.
We are in no way responsible for incorrect information or data and any technical or other inaccuracies provided by third parties that may be contained on Hamradioshop or indicated in the products.

3.7
If you decide to exercise your right to return products purchased from Hamradioshop, please remember that Hamradioshop has the right not to accept returned products that have been altered from their original condition or have been damaged (e.g., without a tag or warranty seal)

3.8
All products are covered by a warranty for conformity defects, lasting no less than 24 (twenty-four) months, provided limited to the Italian territory of the Vatican City State and the Republic of San Marino ("Legal warranty of conformity for consumer goods") as provided by Title III, Chapter I of the Consumer Code (art. 128 et seq.). For purchases with a VAT number, the warranty will last 12 months.

The warranty, provided for the duration indicated above and within the specified territory, applies to products that have a conformity defect, provided that the product itself is used correctly, in compliance with its intended use and as provided in the technical documentation or attached instructions for use. In case of a conformity defect, we will, at our expense, restore the conformity of the product through repair/replacement or a price reduction, unless the contract is terminated if necessary.

Warranty assistance is provided upon presentation of the purchase document and is always ex-works.

We reserve the right to replace the product (at our discretion, also with a product of superior characteristics) or to terminate the sales contract with a refund of the entire sum paid and any additional costs in the event that, for any reason, it is not possible to repair or replace a product under warranty.

We are not responsible for any delays in repairs or replacements carried out by third parties and/or the manufacturer.

In cases where the return of the product is required to benefit from the warranty, the product must be returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.).

We guarantee compliance with the quality standards related to our products only until the time of delivery. We disclaim any responsibility arising from improper use of the products after delivery.

4. Payments

4.1
Payment of product prices and related shipping contributions must be made using one of the procedures indicated during the online purchase phase.

4.2
In the case of payment by debit/credit card, all relevant details (for example, card number or expiration date) will be handled directly on the Paypal online payment site, which provides electronic payment services, without third parties having access to them. Such details will not be used directly by Hamradioshop. We will carry out the entire payment management procedure always through the same payment processor: both for your purchase and for a refund, in accordance with the exercise of your right of withdrawal, or for cases reported as possible fraud by public security authorities. The price for the purchase of products and related contributions for delivery, as indicated in the order confirmation, will be charged to the credit/debit card when the purchased products are shipped.

4.3 If, for any reason, it is not possible to charge the due amount, the sales process will be automatically canceled and the sale will be terminated. You will be informed via an appropriate automatic email notification.

5. Hamradioshop Web Discount Vouchers

5.1
Offerprice web discount vouchers are personal electronic codes that allow you to take advantage of a discount on your purchase from Hamradioshop.

5.2
The box to enter the Hamradioshop discount code is displayed on the first page of the cart: after you have added your items to the cart and entered your electronic code, press the confirm button to view the new total purchase.

5.3
Limitations on the use of web vouchers:

The voucher can only be used once, with the exception of returns (as specified in paragraph 5.4); the voucher can never be exchanged for cash; you cannot use more than one voucher per order unless otherwise stated in the voucher itself; the voucher can only apply to items with a value greater than the voucher itself;
the voucher cannot be used for certain items for sale such as unique samples or for charitable sales;
the web voucher cannot be used in any Hamradioshop stores.

5.4
If for any reason you are not satisfied with your Hamradioshop order, you can return the item to which you applied the web voucher by following the standard return procedure, as described in the Returns section. Once your return is accepted, the respective voucher code will be restored to its original value. The difference in price between the voucher value and the item you purchased will be fully refunded, following the standard refund procedure.

6. Product shipping and delivery

6.1

Shipments

Shipments made by express courier are carried out by our trusted couriers or, if expressly requested, can be picked up by the buyer's trusted carrier.
The goods are delivered ex-works from our warehouse. The goods travel at the risk and peril of the recipient even if shipped carriage paid. Shipping can be insured against theft and partial damage at the buyer's request, agreeing on additional costs with the seller. For this insurance to be effective, the receipt from the shipping carrier for missing or damaged packages, even partially, must be made "with reserve". A copy of the acceptance "with reserve" of the shipment must be sent to us with notification of any damage or theft.
Approximately, an online order is delivered to the carrier within 24 hours. The carrier delivers the goods within 3 days for provincial capitals and 5 days for islands (these times are not binding).

For shipments to remote locations, smaller islands, Venice, and the Venetian lagoon, a variable surcharge will be required depending on the courier used (+7/10 euros).

Pursuant to art. 54 of the Consumer Code, the execution of the purchase order will take place by delivering the products within a maximum period of 30 days, starting from the date of the order and upon payment of the price.

8. Product Returns & Right of Withdrawal.

8.1
You can return products purchased from Hamradioshop without any penalty and without specifying the reason, within ten (10) working days from the receipt of the products purchased from Hamradioshop.

8.2
To return products, please contact Customer Service before shipping the return package to Hamradioshop.

8.3
You must return items to Hamradioshop by contacting us and returning the goods within ten (10) working days from the date you received the products.

8.4
The right of withdrawal - in addition to compliance with the terms and procedures described in paragraphs 8.1, 8.2 and 8.3 above - will be considered correctly exercised once the following circumstances have been fully met: we invite you to correctly fill in and send the online return request; the products must be returned intact, complete with accessories, in their original packaging (in the case of audio CDs, books, drawing items, toys, the packaging must include the relative original seal; if you wish to return a kit/set, it must include all its components); returned items must be shipped to Hamradioshop within ten (10) working days from the date of delivery to the address provided by Customer Service operators.
The right of withdrawal is not allowed in the case of:
a) purchase of sealed packaged products, returned with the packaging no longer sealed;
b) products not substantially intact or showing damage, non-conformities, deterioration and/or alterations of any kind;
c) used products;
d) damaged products;
e) goods which by their nature cannot be returned or are liable to deteriorate.
