1. Our Commercial Policy

1.1
Hamradioshop products available in our Hamradioshop online catalog and the commercial services provided are available to end-users, defined by law as "Consumers" and "non-Consumers".
Product offers and their prices are valid as long as they are visible and purchasable on Hamradioshop, and in any case until stocks last.

1.2
"Consumer" means, according to art. 18 of the Consumer Code, a natural person who acts for purposes unrelated to his or her commercial, industrial, craft or professional activity. We kindly ask you to enter your "VAT number" in your personal data if you do not fall into the category of Consumers.

Hamradioshop reserves the right not to process orders received from users who do not adhere to our commercial policy.

These general terms and conditions of sale exclusively regulate the offer, transmission and acceptance of purchase orders for products on the Hamradioshop website between Hamradioshop portal users and Hamradioshop by Tersigni V. Dino itself, addressed to persons who have reached the age of majority (18 years old).

The general terms and conditions of sale do not regulate the provision of services or the sale of products carried out by third parties who use direct links to the Hamradioshop website through banners or other hyperlinks/links. Before placing orders and purchasing products and services from these third parties, we suggest you check the general terms and conditions of sale and use of these third parties, as Hamradioshop cannot in any case be held responsible for the provision of services promised by third parties or for the execution of e-commerce transactions between Hamradioshop users and third parties.

 

2. How to Conclude a Contract with Hamradioshop

2.1
To place an order to purchase one or more products on the Hamradioshop website, you must complete all the pages in the shopping cart and electronically transmit the page with all personal and purchase data to Hamradioshop, following the instructions you will find after adding a product to the cart and registering for the purchase.

2.2
The order page contains a link to these general terms and conditions of sale and also contains information on the main characteristics of each ordered product and its price (including all applicable taxes), the payment method you used to purchase, the conditions for product delivery, the contributions required for delivery and transport, and references to the general terms and conditions for returning products purchased online.

2.3
An order will be deemed to have been placed when Hamradioshop receives your order proposal electronically and the order information has been preliminarily verified as correct.

2.4
Before forwarding your order proposal to Hamradioshop for the purchase of selected products online, you will be asked to carefully read the general terms and conditions governing the sale and purchase, to print a copy of them using the print option, and to save or request a copy for personal use.

2.5
The order proposal will be stored in our databases for the time required to process your order, in accordance with current legislation. You can access the order by clicking on the section called “MY PROFILE” or by contacting Customer Service. Furthermore, a copy of the electronic evidence relating to the conclusion of the contract will be kept for the period provided for by applicable civil and tax regulations.

Before proceeding with the order submission, you will be asked to identify and correct any possible errors that occurred during the completion of the fields.

Orders submitted to Hamradioshop must be in Italian.

After your order has been registered by Hamradioshop, it will be processed as soon as possible.

2.9
Hamradioshop may not process your order if there are insufficient guarantees of payment solvency, if the orders are incomplete or incorrect, or if the products are no longer available. In the above cases, we will inform you by e-mail that the contract has not been executed and that Hamradioshop has not confirmed your purchase order, specifying the reasons. In addition to the information provided, Hamradioshop is unable to provide more precise indications regarding product availability; therefore, once your order has been examined, we will inform you by e-mail if some of the products you ordered are not available.

Notwithstanding the provisions of the General Conditions, it is understood that this order concerns divisible, distinct and multi-economic unit sales services, corresponding to the number of ordered products, as expressly agreed between the Customer and Hamradioshop with the submission of the order and its acceptance; therefore, in the event that the execution by Hamradioshop of the order is limited to some of the ordered products due to the unavailability of some or for another justified reason beyond Hamradioshop's control, by submitting this order the Purchaser declares his interest and gives his consent to the partial execution of the order regarding the other products, which therefore cannot be refused by the Purchaser, nor can it give the Purchaser the right to revoke the order.
In the event that Hamradioshop is unable to fully accept the order received from the Customer, proceeding with partial acceptance of the order with regard to the available products, any exercise of the right of withdrawal provided for in art. 8 of these General Conditions will occur without any charge for transport costs to the Customer.

2.10
You are aware that by sending the order to Hamradioshop you accept without reservation all the provisions contained in the general terms and conditions of sale of this contract with Hamradioshop and that you undertake to observe them. If you do not agree with any provision contained in these general terms and conditions of sale, we kindly ask you not to send the order for the purchase of products on Hamradioshop.

For cash on delivery orders, in case of non-delivery, storage and shipping costs will be charged.

By submitting your order to Hamradioshop, you consent to and accept these general terms and conditions of sale as well as further conditions contained on Hamradioshop, including through links, including the general terms and conditions of use, the Privacy Policy, and the terms of withdrawal.

When an online order is confirmed, Hamradioshop will transmit to you, at your choice, in writing or via e-mail, the content of which must be stored on a durable medium, a copy of the purchase order receipt, containing a summary with information relating to the order (general terms and conditions of sale, main characteristics of the purchased products, detailed price information, payment terms, existence of the right of withdrawal, times and methods for returning products, contribution for transport requested from the customer, geographical address to which to submit any complaints and information on existing commercial guarantees and assistance services).

2.13
By sending your order to Hamradioshop, you agree to receive the invoice/tax receipt/sales receipt issued for tax purposes in electronic format. You can receive the paper invoice by making an express request to our Customer Service.

3. Guarantees and product price indications

3.1
On Hamradioshop, we offer for sale products purchased by Hamradioshop directly from manufacturers, suppliers and merchants carefully selected for their rigorous and stringent quality controls.

3.2
Products sold by Hamradioshop are of a quality never below the standard of the reference market.

3.3
The main characteristics of the products are indicated on Hamradioshop on the product web page. The products offered for sale on Hamradioshop may not exactly match the actual product in terms of image and colors due to the browser or monitor type used. The images are for illustrative purposes only.
The technical characteristics of a product, the approvals and safety declarations of an HRS branded product and of any other product sold through the Site are indicated on the packaging or in the product's instructions for use and may be reported in full or in extract on the Site itself to accompany the Product illustration.
All HRS branded products comply with standards and are approved as required by European Community regulations. We are not responsible for any discrepancy with the standards of countries not belonging to the European Community and/or lack of product approval in those countries.

3.4
Product prices are expressed in euros and include VAT, excluding shipping costs which will be determined once the cart is complete. Prices are subject to change. Check the final sale price before submitting the order proposal.

3.5
Orders placed from a website in a different country than the goods' delivery country, or to addresses where Hamradioshop cannot deliver (e.g., P.O. Box or territories/areas/zones not reached by our couriers), will be automatically canceled.

3.6
All products are delivered with an attached identification label/tag or sealed. Do not remove the seals of purchased products or the label/tag if you wish to return the purchased product.
We are in no way responsible for incorrect information or data and any technical or other inaccuracies provided by third parties that may be contained on Hamradioshop or indicated in the products.

3.7
Should you decide to exercise your right to return products purchased from Hamradioshop, we remind you that Hamradioshop has the right not to accept returned products that have been altered from their original condition or have been damaged (e.g., without a tag or warranty seal).

3.8
All products are covered by a warranty for defects of conformity, lasting no less than 24 (twenty-four) months, provided limited to the Italian territory of the Vatican City State and the Republic of San Marino ("Legal conformity guarantee for consumer goods") as provided for by Title III, Chapter I of the Consumer Code (articles 128 et seq.), for purchases with a VAT number the warranty will last 12 months.

The warranty, provided for the duration indicated above and within the specified territory, applies to products that present a defect of conformity, provided that the product itself is used correctly, in compliance with its intended use and as provided for in the technical documentation or attached instructions for use. In case of a defect of conformity, we will, at our expense, restore the product's conformity through repair/replacement or price reduction, subject to eventual termination of the contract if necessary.

Warranty assistance is provided upon presentation of the purchase document and is always ex-store.

We reserve the right to replace the product (at our discretion, also with a product of superior characteristics) or to terminate the sales contract with a refund of the entire sum paid and any additional expenses in the event that, for any reason, it is not possible to restore or replace a Product under warranty.

We are not responsible for any delays in repairs or replacements carried out by third parties and/or the manufacturer.

In cases where the return of the product is required to benefit from the warranty, the product must be returned in its original packaging, complete in all its parts (including packaging and any documentation and accessories: manuals, cables, etc...).

We guarantee compliance with quality standards for our products exclusively up to the moment of delivery. We are not liable for any improper use of the products after delivery.

4. Payments

4.1
Payment for the product prices and related shipping contributions must be made using one of the procedures indicated during the online purchase process.

4.2
In the case of payment by debit/credit card, all relevant details (for example, card number or expiry date) will be managed directly on the online payment site Paypal, which provides electronic payment services, without third parties having access. Such details will not be used directly by Hamradioshop. We will carry out the entire payment management procedure always through the same payment provider: both for your purchase or refund, in accordance with the exercise of your right of withdrawal, or for cases reported as possible fraud by public security authorities. The price for the purchase of products and related delivery contributions, as indicated in the order confirmation, will be charged to the credit/debit card when the purchased products are shipped.

4.3 If, for any reason, it is not possible to debit the due amount, the sales process will be automatically cancelled and the sale will be terminated. You will be informed via an appropriate automatic email notification.

5. Hamradioshop Web Discount Vouchers

5.1
Hamradioshop web discount vouchers are personal electronic codes that allow you to take advantage of a discount on your purchase from Hamradioshop.

5.2
The box to enter the Hamradioshop discount code is displayed on the first page of the cart: after you have added your items to the cart and entered your electronic code, press the confirmation button to view the new total purchase.

5.3
Limitations on the use of web vouchers:

the voucher can only be used once, with the exception of returns (as specified in paragraph 5.4); the voucher can never be exchanged for cash; you cannot use more than one voucher per order unless otherwise stated in the voucher itself; the voucher can only apply to items with a value greater than the voucher itself;
the voucher cannot be used for certain items on sale such as unique samples or for charity sales;
the web voucher cannot be used in any way in Hamradioshop stores.

5.4
If for any reason you are not satisfied with your Hamradioshop order, you can return the item to which you applied the web voucher by following the standard return procedure, as described in the Returns section. Once your return is accepted, the respective voucher code will be restored to its original value. The difference in price between the voucher value and the item you purchased will be fully refunded, following the standard refund procedure.

6. Product shipping and delivery

6.1

Shipping

Shipments made by express courier are carried out by our trusted couriers or, if expressly requested, can be collected by the buyer's trusted carrier.
The goods are understood to be delivered ex-works from our warehouse. The goods travel at the recipient's risk, even if shipped carriage free. Shipping can be insured against theft and even partial damage upon request of the buyer by agreeing on additional costs with the seller. For this insurance to be effective, receipt of the shipping carrier with missing or partially damaged packages must be made "subject to internal inspection". A copy of the "subject to inspection" acceptance of the shipment must be sent to us with notification of any damage or theft.
An online order is typically delivered to the carrier within 24 hours. The carrier delivers the goods within 24/48 hours and within 5 days for smaller islands (these times are not binding).

For shipments to remote areas, smaller islands, Venice and the Venetian lagoon, a variable surcharge will be requested depending on the courier used (+7/15 euros).

Pursuant to art. 54 of the Consumer Code, the execution of the purchase order will take place with the delivery of the products within a maximum period of 30 days, starting from the order date and upon successful payment of the price.

8. Product returns & Right of Withdrawal.

8.1
You can return products purchased from Hamradioshop without any penalty (excluding payment commission costs if any, depending on the chosen payment method) and without specifying the reason, within fourteen (14) working days from the receipt of products purchased from Hamradioshop, complete with the accompanying tax documentation.

8.2
To return products, please contact Customer Service before shipping the return package to Hamradioshop.

8.3
You must return the items to Hamradioshop by contacting us and returning the goods within fourteen (14) working days from the date you received the products.

8.4
The right of withdrawal - in addition to compliance with the terms and procedures described in paragraphs 8.1, 8.2 and 8.3 above - will be considered correctly exercised once the following circumstances have been fully met: we invite you to correctly fill out and send the online return request; the products must be returned intact, complete with accessories, in their original packaging (in the case of audio CDs, books, drawing items, toys, the packaging must include the original seal; if you wish to return a kit, it must include all its components); returned items must be shipped to Hamradioshop within fourteen (14) working days from the delivery date to the address provided by Customer Service operators.
The right of withdrawal is not allowed in the case of:
a) purchase of sealed packaged products, returned with the packaging no longer sealed;
b) products not substantially intact or that show damage, discrepancies, deterioration and/or alterations of any kind;
c) used;
d) damaged;
e) goods that by their nature cannot be returned or are liable to deteriorate.

REFUNDS FOR ORDER CANCELLATION

1 If the cancellation and refund of an order for products marked as "Arriving", "Not immediately available" or "Ask for delivery times", paid by credit card or Paypal, is requested, the bank commission costs paid on the transaction will be deducted from the refund.
